1. OVERVIEW

This website is operated by Ninoma. Throughout the site, the terms “we”, “us” and “our” refer to Ninoma. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

2. ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

3. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

4. PRODUCTS, PRE-ORDERS, AND PRICING

  • Accuracy: We reserve the right to change product descriptions or pricing at any time without notice.

  • Stock Availability: We strive for accuracy, but occasional stock discrepancies may occur. If an item is found to be out of stock after an order is placed, we reserve the right to cancel the order and issue a full refund. Ninoma is not liable for any further compensation in such cases.

  • Pre-orders: Release dates for pre-order items are estimates and subject to manufacturer delays.

  • Cancellations: Any cancellation request is subject to a cancellation fee of 10% of the item price (Minimum 1,000 JPY). Orders already processed or shipped cannot be canceled. For special sourced items, all sales are final. Please refer to our Refund Policy for full details regarding fees and round-trip shipping responsibilities.

  • Candy Toys: Products containing food items (gum, candy, etc.) are sold as collectibles. We do not guarantee food freshness and strongly advise against consumption. Ninoma is not liable for any health issues related to food items.

5. SHIPPING AND RISK OF LOSS (International Shipping)

  • Shipment Contract: All items purchased from Ninoma are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery of the items to the carrier (Japan Post, DHL, FedEx, etc.).

  • Non-Insured Shipping (E-Packet Light / Surface Mail): By selecting a non-insured shipping method, you acknowledge that Ninoma is not liable for any loss, theft, or damage during transit. No compensation will be provided for packages marked as "Delivered" or "Dispatched" in the tracking system.

  • Delivery Responsibility: Certain methods (e.g., E-Packet Light) are delivered to your mailbox. Ninoma is not responsible for theft after delivery to the designated address.

6. CUSTOMS, DUTIES, AND TAXES

  • Buyer’s Responsibility: You are responsible for assuring the product can be lawfully imported to the destination country. Orders shipped outside of Japan may be subject to import taxes, customs duties, and fees. These charges must be fulfilled by the recipient.

  • Refusal of Shipment: If a shipment is refused or unclaimed at customs and returned to us, original shipping fees are non-refundable. Any return shipping costs and a 10% restocking fee will be deducted from your refund.

7. RETURN AND REFUND POLICY

  • Outer Box Condition: The product packaging (outer box) is for protection only. Minor dents, scuffs, or corner wear on the box incurred during international transit are not considered damage and are not eligible for returns or replacements.

  • Sealed Items: Items must be returned in their original, unopened, and factory-sealed condition within 7 days of delivery.

  • Manufacturer Defects: For defects inside a sealed product (e.g., painting errors), customers must contact the manufacturer directly.

8. PROHIBITED USES

In addition to other prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to infringe upon our intellectual property rights; (c) to submit false or misleading information; (d) to upload viruses or malicious code.

9. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

Ninoma does not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. In no case shall Ninoma, our directors, officers, or employees be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind.

10. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Ninoma and our parent, subsidiaries, partners, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to your breach of these Terms of Service.

11. SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.

12. TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

13. GOVERNING LAW AND JURISDICTION

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Japan. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Fukuoka District Court, Japan.
